Términos y Condiciones

CLÁUSULA 1.- EMPRESA ORGANIZADORA

COFFEE IS INCAPTO, S.L. (en adelante, “INCAPTO”), con domicilio en Barcelona, CP 08018, Carrer de Meridional 9, Barcelona, y CIF nº B67609404, organiza en las fechas indicadas a continuación la promoción denominada INCAPTO DAYS ‘26 (en adelante, la “Promoción”), de acuerdo con los requisitos que se recogen en las presentes Bases Legales.

CLÁUSULA 2.- DURACIÓN, ÁMBITO TERRITORIAL Y PARTICIPANTES

1. La presente acción promocional se llevará a cabo desde el 16/06/2026 hasta el 22/06/2026, ambos inclusive.

2. La comunicación de los ganadores se realizará el día 25/06/2026 por correo electrónico.

3. La Promoción se llevará a cabo a nivel nacional en todo el territorio español.

4. Podrá participar en la Promoción cualquier persona física que, durante el periodo indicado, realice una compra superior a 35 € en la página web de INCAPTO y cumpla con los requisitos establecidos en las presentes Bases Legales.

5. Asimismo, los suscriptores de INCAPTO participarán de forma automática en la Promoción, de acuerdo con la mecánica definida por INCAPTO.

6. A efectos de esta promoción, los términos “participante”, “consumidor” y “usuario” tendrán el mismo significado, siempre correspondiente a una persona física.

7. No podrán participar en esta Promoción las personas jurídicas.

CLÁUSULA 3.- MECÁNICA

1. Durante el periodo de vigencia de la Promoción, los clientes que realicen una compra superior a 35 € participarán automáticamente en el sorteo de cinco (5) suscripciones anuales trimestrales de café gratis.

2. Cada pedido válido superior a 35 € generará una participación en el sorteo.

3. El importe mínimo de compra de 35 € deberá alcanzarse una vez aplicados descuentos, cupones o promociones, y no incluirá, en su caso, los gastos de envío, salvo que INCAPTO indique expresamente lo contrario.

4. Quedarán excluidos del sorteo los pedidos cancelados, devueltos, fraudulentos o cuyo pago no haya sido completado correctamente.

5. El sorteo se realizará de forma aleatoria entre todos los participantes que cumplan los requisitos establecidos en las presentes Bases Legales. INCAPTO podrá utilizar una herramienta interna o externa que garantice la aleatoriedad del resultado.

6. INCAPTO podrá seleccionar ganadores suplentes para el caso de que alguno de los ganadores iniciales no responda, rechace el premio o no cumpla los requisitos de participación.

7. Cada ganador recibirá una suscripción de un (1) año de duración, compuesta por cuatro (4) pedidos trimestrales, con un máximo de 1,5 kg de café gratis en cada pedido.

8. La suscripción premiada será gestionada por el equipo de Atención al Cliente (ATC) de INCAPTO. El ganador podrá modificar la fecha de su pedido, pero dicha modificación deberá tramitarse siempre a través de ATC.

9. En caso de que el ganador quiera comprar más café del incluido en su suscripción premiada, deberá realizar una compra puntual independiente, fuera de esta suscripción.

10. Una vez finalizado el periodo de un año de duración del premio, si el ganador deseara continuar con la suscripción, deberá activarla por su cuenta a través de la página web de INCAPTO.

11. Los detalles concretos de la Promoción y de la gestión del premio serán determinados únicamente por INCAPTO.

12. No se permitirá la sustitución del premio por su valor en efectivo ni por otro premio distinto, salvo a discreción de INCAPTO. El premio es personal e intransferible. No se permite su transferencia o cesión a terceros por parte del usuario.

13. INCAPTO comunicará los ganadores por correo electrónico el día 25/06/2026 y se pondrá en contacto con ellos para comunicarles los pasos a seguir para la gestión de la suscripción premiada.

14. El ganador dispondrá de un plazo de siete (7) días naturales desde la comunicación del premio para responder y aceptar el premio. En caso de no recibir respuesta dentro de dicho plazo, INCAPTO podrá asignar el premio a un ganador suplente.

15. En caso de que INCAPTO quisiera utilizar el nombre, imagen o testimonio del ganador con fines promocionales relacionados con la Promoción, solicitará previamente la autorización correspondiente.

CLÁUSULA 4.- ACEPTACIÓN DE LAS BASES Y RESPONSABILIDAD

La participación en la Promoción implica la aceptación íntegra de las presentes Bases Legales.

Al participar en la Promoción, el participante acepta cumplir y acatar estas Bases y las decisiones de INCAPTO, y declara y garantiza que cumple con los requisitos de elegibilidad. Asimismo, acepta que las decisiones de INCAPTO serán definitivas y vinculantes en todo lo relativo a esta Promoción.

INCAPTO se reserva el derecho a:

(i) modificar las Bases de la Promoción, parcial o totalmente, en cualquier momento, siempre que no perjudique o menoscabe los derechos de los participantes; y

(ii) anularla o dejarla desierta en caso de detectarse alguna irregularidad.

Cualquier modificación será debidamente puesta en conocimiento de los participantes.

Asimismo, INCAPTO se reserva el derecho de excluir de la participación a aquellos participantes que incumplan cualquier requisito o condición de participación incluida en las presentes Bases o que utilicen la Promoción de manera abusiva o fraudulenta. La exclusión de un participante, cualquiera que sea la causa, conllevará la pérdida de todos los derechos derivados de su condición como tal.

La Promoción no está patrocinada, respaldada, administrada ni asociada de ninguna manera con Facebook, Instagram, TikTok, LinkedIn o cualquier otra red social en la que pudiera difundirse. El participante comprende que está facilitando su información a INCAPTO y no a dichas plataformas.

INCAPTO queda exenta de toda responsabilidad derivada de cualquier acción u omisión imputable a terceros o a los participantes y/o ganadores, que pueda afectar al desarrollo de la Promoción y/o a la entrega o disfrute del premio.

CLÁUSULA 5.- TÉRMINOS Y CONDICIONES

INCAPTO se reserva el derecho, a su entera discreción, de cancelar, terminar, modificar o suspender la Promoción en caso de virus, errores, intervención humana no autorizada, fraude u otra causa fuera de su control que pudiera afectar a la administración, seguridad, equidad o desarrollo normal de la Promoción.

INCAPTO se reserva igualmente el derecho de descalificar a cualquier persona que altere o intente alterar el proceso de participación o el funcionamiento de la Promoción o del sitio web, o que infrinja estas Bases.

INCAPTO podrá anular participaciones múltiples, fraudulentas o realizadas mediante bots, macros, scripts u otros medios técnicos destinados a alterar el normal funcionamiento del sorteo.

Cualquier intento por parte de un participante de dañar deliberadamente cualquier sitio web o socavar el funcionamiento legítimo de la Promoción podrá constituir una infracción de las leyes penales y civiles, reservándose INCAPTO el derecho a reclamar daños y perjuicios en la máxima medida permitida por la ley.

Asimismo, INCAPTO se reserva el derecho de modificar o ampliar estas Bases Legales en la medida en que ello no perjudique o menoscabe los derechos de los participantes.

CLÁUSULA 6.- CAUSAS DE DESCALIFICACIÓN DE UN PARTICIPANTE

La Promoción se organiza con la pretensión de incentivar y fomentar la participación en condiciones de igualdad y con estricto respeto al principio de buena fe.

Por ese motivo, INCAPTO excluirá automática e inmediatamente de la Promoción a cualquier participante que transgreda las normas de honradez y buena fe, observe una conducta mendaz, inadecuada, falaz o impropia, emplee medios desproporcionados, fraudulentos o abusivos, o incumpla estas Bases en cualquiera de sus extremos.

Asimismo, INCAPTO se reserva el derecho de descalificar a aquellos participantes que no cumplan con las condiciones establecidas en la cláusula 3 de las presentes Bases.

CLÁUSULA 7.- LIMITACIÓN DE RESPONSABILIDAD

Al participar en la Promoción, el participante acepta liberar y eximir de responsabilidad a INCAPTO y a sus socios, representantes, agentes, empleados, directivos y administradores de cualquier responsabilidad, pérdida, daño, lesión, reclamación o perjuicio que pudiera derivarse, directa o indirectamente, de:

• La participación en la Promoción y/o la aceptación, posesión, uso o mal uso del premio.
• La intervención humana no autorizada en cualquier parte de la Promoción.
• Errores técnicos o humanos en la administración de la Promoción o en el procesamiento de participaciones.
• Fallos técnicos de cualquier tipo, incluidos, entre otros, el funcionamiento defectuoso de sistemas, redes, hardware o software.
• La indisponibilidad o inaccesibilidad de servicios de Internet o de correo electrónico.
• Errores de impresión o publicación.
• Correos electrónicos perdidos, retrasados, mal dirigidos o no entregados.

CLÁUSULA 8.- PROTECCIÓN DE DATOS DE CARÁCTER PERSONAL

Los datos personales de los participantes en esta Promoción serán tratados de conformidad con el Reglamento (UE) 2016/679, General de Protección de Datos (“RGPD”), y con la normativa nacional que resulte de aplicación.

Responsable:
COFFEE IS INCAPTO, S.L., con domicilio en Barcelona, CP 08018, Carrer Meridional 9, Barcelona, y CIF nº B67609404.

Finalidad y legitimación:
Gestionar la participación en la Promoción, contactar con los ganadores y gestionar la entrega y disfrute del premio, siendo la base legitimadora la ejecución de la relación promocional y el consentimiento del participante.

Datos tratados:
Los facilitados por el participante en el formulario de inscripción, así como aquellos otros que puedan solicitarse para la correcta gestión de la Promoción.

Destinatarios:
No se prevé la cesión de datos a terceros salvo obligación legal o cuando sea necesario para la correcta gestión del premio.

Plazo de conservación:
Los datos serán tratados durante el tiempo necesario para la gestión de la Promoción y, posteriormente, durante los plazos legalmente exigibles.

Derechos:
El participante podrá ejercer sus derechos de acceso, rectificación, supresión, oposición, portabilidad, limitación del tratamiento y revocación del consentimiento mediante correo electrónico a hello@incapto.com o por escrito a la dirección postal del responsable, adjuntando copia de su documento identificativo.

Puede consultar información adicional y detallada sobre Protección de Datos en la Política de Privacidad de INCAPTO. Asimismo, podrá presentar reclamación ante la Agencia Española de Protección de Datos.

CLÁUSULA 9.- FISCALIDAD

El premio estará sujeto a la normativa fiscal vigente aplicable en cada momento.

En su caso, INCAPTO practicará las retenciones o ingresos a cuenta que resulten legalmente exigibles y podrá solicitar al ganador la información necesaria para cumplir con dichas obligaciones fiscales.

CLÁUSULA 10.- LEY APLICABLE Y JURISDICCIÓN

Estas Bases Legales se rigen por la legislación española.

Cualquier reclamación relacionada con la Promoción deberá dirigirse por correo electrónico a hello@incapto.com en los treinta (30) días posteriores a la fecha de finalización del periodo de participación.

En caso de controversia en la aplicación o interpretación de estas Bases y a falta de acuerdo amistoso, las partes se someterán a los Juzgados y Tribunales que resulten competentes conforme a la normativa aplicable.

CLAUSE 2.- DURATION AND TERRITORIAL SCOPE AND PARTICIPANTS 

1. This promotional action will take place from Saturday 01/01/2021.
2. The Promotion will take place globally.
3. Any natural person may participate in the Promotion. 
4. Legal entities may not participate in this Promo.
5. We refer to “customer” as people who are currently customers of Incapto and “guests” are the people to whom the coupon is shared with the aim of purchasing from Incapto.

 CLAUSE 3.- MECHANICS

1. The customer can share a personalized coupon via email or WhatsApp through the following link.  
2. This coupon has a value of €25 that any user can use to purchase a coffee maker.
3. Once the guest has used the coupon in the purchase, the customer will receive a €25 balance in their account, which will be applied to future purchases or the coffee subscription.
4. In order to access the promotion, guests must purchase through the website www.incapto.com and/or the physical points of sale of Incapto, any model of coffee maker Incapto.
5. This promotional action cannot be combined with other promotions and/or offers. 

The details of the Promo will be determined solely by INCAPTO. No cash or other substitution of promotion will be permitted except at the discretion of INCAPTO. The promotion is non-transferable. Substitution of the Promo or transfer/assignment of the same to others or request for the cash equivalent of the promotion by the user is not permitted. Acceptance of the promotion constitutes permission for INCAPTO use users' name, likeness, and entry for advertising and business purposes without additional compensation, unless prohibited by law. Note: in the event that the participant does not deliver the capsule coffee maker, INCAPTO will charge the value of the promotion (€20) given non-compliance with this clause.  

CLAUSE 4.- ACCEPTANCE OF THE BASES AND RESPONSIBILITY. By participating in the Promo, the participant agrees to comply with and abide by these Rules and the decisions of INCAPTO, and you represent and warrant that you meet the eligibility requirements. Furthermore, the participant agrees to accept the decisions of INCAPTO as final and binding with respect to the content of this campaign. Participants must look only at INCAPTO with any questions, comments or problems related to the Promo.

1. The mere fact of participating in the Promo implies full acceptance of these Rules.
2. INCAPTO reserves the right to: (i) modify the Promotion Bases, partially or totally at any time to the extent that it does not harm or undermine the rights of the participants in the Promo, and (ii) to cancel it or leave the promotion void if any irregularity is detected. Once any modification is made, it will be duly made known to the participants.
3. Likewise, INCAPTO reserves the right to exclude from participation in the Promo all those participants who, it deems, are failing to comply with any requirement or condition of participation included in these Rules or using them in an abusive or fraudulent manner. The exclusion of a participant, whatever the cause, entails the loss of all rights derived from their condition as such. 
4. The Promo is in no way sponsored, endorsed, administered by or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social media platform used to share the Promo. Entrant understands that they are providing their information to the Promo owner and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social network. In this sense, participants release Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social network from all responsibility for any damages that may arise from it.
5. INCAPTO is exempt from all liability derived from any action or omission attributable to third parties or to the participants and/or winners of the Promo, which may affect the development of the Promo and/or the delivery of the promotion.

 CLAUSE 5.- TERMS AND CONDITIONS INCAPTO reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promo in the event of viruses, bugs, unauthorized human intervention, fraud or other cause beyond the control of INCAPTO corrupt or affect the administration, security, fairness or proper conduct of the Promo. In such cases, INCAPTO may select one of the winners from eligible entries received before and/or after the action taken by INCAPTO, if applicable. INCAPTO reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promo or the website or who violates these Terms and Conditions. INCAPTO has the right, at its sole discretion, to maintain the integrity of the Promo, to void registrations for any reason, including, but not limited to: multiple registrations by the same user from different IP addresses; multiple entries from the same computer in excess of what is permitted by the Promo rules; or the use of bots, macros, scripts or other technical means to enter. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promo may be a violation of criminal and civil laws. If such a case occurs, INCAPTO reserves the right to seek damages to the fullest extent permitted by law. Likewise, INCAPTO reserves the right to modify or expand these promotional bases, to the extent that it does not harm or undermine the rights of the participants in the Promo. 

CLAUSE 6.- CAUSES FOR DISQUALIFICATION OF A PARTICIPANT FROM THE PROMO The Promo is organized with the aim of encouraging and encouraging the participation of all participants under conditions of equality and with strict respect for the general principle of good faith. For that reason, INCAPTO will automatically and immediately exclude from it any participant who transgresses the rules of honesty and good faith, observes mendacious, inadequate, fallacious or improper conduct, uses disproportionate, fraudulent or abusive means, or fails to comply with these Rules in any of their extremes. Likewise, INCAPTO reserves the right to disqualify from the promotion those participants who do not comply with the conditions of clause 3 of this legal basis. 

CLAUSE 7.- LIMITATION OF LIABILITY  By participating in the Promo, the participant agrees to release and hold harmless INCAPTO and its partners, representatives, agents, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may arise, directly or indirectly, whether caused by negligence or not, from:

• Such participant's participation in the Promo and/or his/her acceptance, possession, use or misuse of any promotion or part thereof.
• Unauthorized human intervention in any part of the Promo
• Electronic or human error in the administration of the Promo or the processing of entries
• Technical errors of any kind, including, but not limited to, malfunction of any computer, cable, network, hardware or software, or other mechanical equipment.
• The unavailability or inaccessibility of any streaming, telephone or Internet service.
• Printing errors.
• Lost, late, postage-due, misdirected, or undeliverable mail.

 CLAUSE 8.- PROTECTION OF PERSONAL DATA The participants of the Promo unequivocally consent that their personal data (data provided or others that we may additionally request for the development of the aforementioned purposes) may be communicated to third parties by disseminating them through the means that INCAPTO deem more convenient. The personal data of the participants in this promotion will be processed in strict compliance with the provisions of Regulation (EU) 2019/679, of April 27, 2016, general data protection ("RGPD") as well as the national legislation applicable at the time of the Promo.

For the development of the purposes set forth above, it is not expected that your data will be communicated to third companies, except for legal obligation and for what is necessary for the management of the prior.

• Conservation period:

Once the Promo ends, your data will not be processed.

• Rights:

Access, rectification, opposition, deletion, portability, revocation of consent previously given and limitation of processing, which may be exercised by email hello@incapto.com or in writing to the postal address of the person responsible, attaching a copy of their identity document (DNI or NIE). You can consult additional and detailed information on Data Protection in our privacy policy: https://incapto.com/politica-de-privacidad/. You may also file a claim with the Spanish Data Protection Agency www.aepd.es  

CLAUSE 9.- APPLICABLE LAW AND JURISDICTION These Bases are subject to Spanish legislation. Any claim related to the Promo must be sent by email to COFFEE IS INCAPTO to the address hello@incapto.com, within thirty (30) days following the deadline for participation in the Promo. In case of controversy in the application or interpretation of these Bases and in the absence of an amicable agreement, all litigation will be subject to the Courts of the city of domicile of INCAPTO.

4. Legal entities may not participate in this Promo.

  CLAUSE 3.- MECHANICS

1. By using the BYECAPSULAS coupon, a €20 discount will be granted for the purchase of a coffee maker Incapto with coffee subscription and delivery of a capsule coffee machine.
2. In order to access the promotion, participants must purchase through the website www.incapto.com and/or the physical points of sale of Incapto, any model of super-automatic and/or semi-automatic coffee machine with coffee subscription.
3. Upon delivery of the coffee maker Incapto, The participant must deliver to the staff of Incapto your capsule coffee machine in order to recycle it.
4. There are no limits on the use of the coupon, therefore, the same participant may use it more than once, as long as they deliver the capsule coffee maker at the time of receiving the coffee maker. Incapto.
5. This promotional action cannot be combined with other promotions and/or offers. 
6. The products offered are within the limits of the available quantities. If your order exceeds stock, you will be informed immediately.
7. All confirmed orders will be delivered to the delivery address that the Client specified when placing their order and in the period of time linked to the service chosen by the Client and that will be confirmed with their order.

For that reason, INCAPTO will automatically and immediately exclude from it any participant who transgresses the rules of honesty and good faith, observes mendacious, inadequate, fallacious or improper conduct, uses disproportionate, fraudulent or abusive means, or fails to comply with these Rules in any of their extremes. Likewise, INCAPTO reserves the right to disqualify from the promotion those participants who do not comply with the conditions of clause 3 of this legal basis. 

CLAUSE 7.- LIMITATION OF LIABILITY  By participating in the Promo, the participant agrees to release and hold harmless INCAPTO and its partners, representatives, agents, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may arise, directly or indirectly, whether caused by negligence or not, from:

• Such participant's participation in the Promo and/or his/her acceptance, possession, use or misuse of any promotion or part thereof.
• Unauthorized human intervention in any part of the Promo
• Electronic or human error in the administration of the Promo or the processing of entries
• Technical errors of any kind, including, but not limited to, malfunction of any computer, cable, network, hardware or software, or other mechanical equipment.
• The unavailability or inaccessibility of any streaming, telephone or Internet service.
• Printing errors.
• Lost, late, postage-due, misdirected, or undeliverable mail.

CLAUSE 8.- PROTECTION OF PERSONAL DATA The participants of the Promo unequivocally consent that their personal data (data provided or others that we may additionally request for the development of the aforementioned purposes) may be communicated to third parties by disseminating them through the means that INCAPTO deem more convenient. The personal data of the participants in this promotion will be processed in strict compliance with the provisions of Regulation (EU) 2019/679, of April 27, 2016, general data protection ("RGPD") as well as the national legislation applicable at the time of the Promo.

(hereinafter, INCAPTO) with address in Barcelona CP 08018, Carrer de la Llacuna 162, Barcelona Activa, floor 2, and CIF no. development of the purposes set out above, it is not expected that your data will be communicated to third companies, except for legal obligation and for what is necessary for the management of the prior. Once the Promo has ended, your data will not be processed. Access, rectification, opposition, deletion, portability, revocation of consent previously given and limitation to processing, which you may exercise via email hello@incapto.com or in writing to the postal address of the person responsible, attaching a copy of their identity document (DNI or NIE). You may also file a claim with the Spanish Data Protection Agency www.aepd.es   

CLAUSE 9.- APPLICABLE LAW AND JURISDICTION These Bases are subject to Spanish legislation. Any claim related to the Promo must be sent by email to COFFEE IS INCAPTO to the address hello@incapto.com, within thirty (30) days following the deadline for participation in the Promo. In case of controversy in the application or interpretation of these Bases and in the absence of an amicable agreement, all litigation will be subject to the Courts of the city of domicile of INCAPTO.
